Fisheye clasp missing a round hoop hard to open

I have to say this is a very elegant necklace. But the one I received seems defective. The fisheye is weirdly attached. The round hoop that should be free to move is stuck to the clasp. I can't even hold it in my two fingers to operate, opening and closing properly. I will be returning it.

Are the beats are real gold?

It is over all looks good. I am not sure about gold beats. Are they gold? The necklace came in a small package and inside ziploc plastic bag. There was no jewelry box or anything and without any kind of certificate what it is made of.
